Supreme Court Lets "State Secrets" Case Go Unheard

The government’s “state secrets” claim prevailed as the Supreme Court refused to hear a lawsuit for damages brought by a German citizen who said he had been wrongly abducted and tortured by the CIA in what turned out to be a case of mistaken identity. The administration urged that the suit be dismissed without a hearing “to protect classified intelligence sources.” A federal judge in Alexandria, Va., agreed. The decision was upheld by the 4th U.S. Circuit Court of Appeals in Richmond, Va. (10/10/07)
